process of ending a marriage. A couple can only commence divorce
proceedings if they have been married for more than 1 year.
We can help resolve the
problems arising from your marriage with our specialist department.
We can use all our experience in obtaining the best solution
for you. We attempt to make the procedure of divorce as simple,
swift and amicable as possible.
Alternatively, if you do
not wish to divorce for social or religious reasons, we can advise
you in relation to judicial separation proceedings or prepare a
separation agreement.
If you would like further
information please do not hesitate to contact anyone of our helpful
family law solicitors who would be more than happy to address any
queries you may have.
Financial and Property
Claim
You and your spouse may be able to reach an
agreement as to financial arrangements arising from a divorce or
separation including maintenance and how property and other assets
may be divided. If this
is the case we may assist you in recording the agreement in a Deed
of Separation or file a Consent Order with the Court and it will
therefore not be necessary for you to attend Court.
If an agreement has not been reached, we will be happy to
help you to agree a financial settlement which is realistic and
enables you to retain sufficient assets and income for your future
life
Our expert advice and negotiating skills will
ensure that you retain a fair share of the matrimonial assets
acquired during your relationship.
We can also look at protecting your interest and pension
rights accrued by either yourself or your spouse.
As a member of Resolution we are committed to helping you in
a sensitive, constructive and cost effective way.
If no Agreement can be reached applications can
be made to the Court for periodical payments, i.e. maintenance, lump
sum property adjustment orders and orders in relation to pensions.
When making any decision relating to financial
matters, the Court will take regard of all the circumstances of the
case and put the welfare of the children first.
We will advise you about Court procedures
including preparation of financial statements, valuation of
properties, documents that need to be disclosed and representation
in Court if you are required to attend.
